Second indictment filed against constable

A federal grand jury has added a second indictment against Wood County Prec. 2 Constable Kelly Smith.

Smith was previously indicted for deprivation of rights under color of law for allegedly directing his police dog to bite suspect Robert Evans. He was being arrested on a warrant at a Hawkins residence July 25, 2022.

The second indictment, filed Feb. 8, is for falsification of a document.

The indictment states that Smith made false entries in an affidavit by stating that the suspect failed to comply with commands and by stating that he gave the police dog heel commands.

The indictment alleges Smith gave the suspect no commands and gave the dog the bite command.

The false entry charge carries a maximum sentence of 20 years in prison and a $250,000 fine.

Smith’s trial in federal court in Tyler is scheduled to begin June 26 with jury selection.

The first indictment was returned Nov. 10.
