District court sets sentences for pleas

The following guilty plea were heard in 402snd District Court last week and sentences assessed:

Steven Wayne Read, Mineola, injury to a child, third degree felony, six years in state prison with 193 days credit for time served, $2,500 fine; burglary of a building, state jail felony, 18 months in state jail with 142 days credit for time served (two counts); assessments totaling $6,287. 

Sean Michael McCown, Winnsboro, assault causes bodily injury of family member impeding breathing/circulation, third degree felony, deferred adjudication, seven years community supervision with 160 hours community service, $1,000 fine; burglary of a building, state jail felony, two years community supervision with 120 hours of community service

James Aaron Ellison, Winnsboro, possession of a controlled substance penalty group 1/1-B less than one gram, state jail felony, 20 months in state jail with 389 days credit for time served, $1,000 fine.

Corde William Berry, Mineola, burglary of a habitation, second degree felony, five years community supervision, $2,500 fine.

Richard Alan Nicholson, Mineola, manufacture or delivery of a controlled substance PG 1 four grams or more but less than 200, first degree felony, eight years in state prison with 767 days credit for time served, $1,500 fine.

Michael Ray Powell Jr., Grand Saline, robbery, second degree felony, two years in state prison with 743 days credit for time served, $1,500 fine.

Bobby Joe Lindley, Winnsboro, evading arrest with a motor vehicle, 10 years in state prison with 399 days credit for time served, $5,000 fine; PSC PG1 less than one gram, state jail felony, dismissed; burglary of a habitation, second degree felony, dismissed.

John Paul Charo, Winnsboro, repeated violation of certain court orders or conditions of bond in family violence, five years in state prison with 336 days credit for time served, $2,000 fine.

Gregory Michael Bennett, Hawkins, PCS PG1/1-B less than one gram, state jail felony, 15 months in state jail with 285 days credit for time served.

Alan Wayne Phipps, Quitman, PCS PG1/1-B one gram or more but less than four, third degree felony, six years in state prison with 455 days credit for time served; theft of property more than $100 but less than $750, Class B misdemeanor, 90 days in county jail; fraudulent possession of identifying information 10 or more, second degree felony, dismissed.

The following probations were revoked and sentences assessed:

Dustin Floyd Willoughby, Mineola, assault peace officer, second degree felony, eight years in state prison with 59 days credit for time served.

Nelson Douglass Driver, Yantis, failure to comply with sex offender registration, state jail felony, 18 months in state jail with 481 days credit for time served.
